DMV Hearings
DMV Hearings
The NC DMV has the power to suspend or revoke your license for several reasons. Finding out that you have a suspended or revoked license can be nerve-wrecking and lead to major inconveniences. Even worse is when your driver’s license has been revoked permanently. However, a knowledgeable DMV Hearing attorney will be able to assess and offer guidance in fixing the problems to get you back on the road.
Some reasons the DMV may suspend your NC driver’s license include:
- Failing to appear in court
- Failing to pay
- Speeding
- Two or more speeding tickets in a year
- Ignition Interlock Violation
- Receiving a moving violation during a period of active revocation
- Blood or breath test refusal
- Accumulating 12 driver’s license points.
- Driving While Impaired convictions
An assessment of your driving record can determine the reason your license has been suspended or revoked and what needs to be done to restore your privileges. Certain violations require mandatory suspension times. For example, a first offense DWI conviction requires a minimum mandatory of one year suspension. Under this and other circumstances, you may be eligible for a limited driving privilege.
In some instances, such as three or more DWI or Driving While License revoked convictions and three or more moving violations during a time of suspension or revocation, your license will be permanently revoked. However, permanent does not mean that you will never be able to drive. Typically, after a certain period, you can apply for a DMV hearing.
The DMV hearing is an informal proceeding before an administrative hearing officer that will hear evidence in regard to your revocation to determine if you meet the requirements to have the revocation lifted. In NC, you must request in writing and pay the applicable fees for a hearing. Hearings will not be set if the fees are not set.
Hearing fees are as follows:
